HB 4168 - REMARKS

REPRESENTATIVE D. BONNEN: This is the bill we dealt with yesterday for Fort Bend and Brazoria Counties at the dislike of Galveston. I believe there is an amendment that I will not be accepting.

Representative G. Bonnen offered the following amendment to HB 4168:

Amend HB 4168 as follows:
(1)  On page 4, line 7, strike "2015" and substitute "3015".
(2)  On page 4, line 8, strike "2015" and substitute "3015".

REPRESENTATIVE G. BONNEN: This is a very simple amendment. It is the most simple amendment you're going to see the entire legislative session. We're only going to change one digit in this bill. We're going to change the number two to the number three so the effective date of the changes to the governance structure of the Gulf Coast Water Authority will move from September 1, 2015 to September 1, 3015. This way the speaker pro tempore can pass his bill, and we'll have plenty of time to not deal with the nasty consequences of this legislation in our lifetime. So this amendment may seem a little bit ridiculous, but I would suggest to you it is actually less ridiculous than two counties that represent 25 percent of the revenue for the Gulf Coast Water Authority going to the legislature and taking a controlling interest on the board of the Gulf Coast Water Authority. As you heard, it's not acceptable to the author. So I would ask that if you are not going to vote for the amendment that you would please white light this amendment.

D. BONNEN: Members, I think we had a nice discussion about all this yesterday. I appreciate the effort that's being made, but obviously we need to table the amendment; or actually, we can just vote it up and down.

REPRESENTATIVE FAIRCLOTH: Somehow being here reminds me of what's said about an NFL quarterback---after you throw an interception, you need to have a short memory. So we're back again today, and here's why: 75 percent of the revenue that's generated from the Gulf Coast Water Authority is generated in Galveston County. Now, I want you to think about that. Let me give you an example. You and I work together on a team. I work three days; you work one day. You work a half a day; your partner works half a day. At the end of the week we all get paid the same. Now, something about that just doesn't seem right. I work three days, you work a half a day, you work a half a day---and we're all equal. That's just not right. That is absolutely not right.
So here's the other thing---bear with me one second. In the next five years it's anticipated that $100 million, in that neighborhood, will be issued for capital improvement projects. Now what does that mean? How are those bonds going to be paid back? Those bonds will be paid to the revenues---75 percent of those bond payments will come out of Galveston County; 25 percent will come from the other two counties. I don't think you would want this in your county. We don't want it in ours. I'm perfectly willing to do this. I'm perfectly willing to promise you that we will work to make sure that this issue gets resolved to the satisfaction---if we all sit down like adults like we know how to do. So here's what I ask you to do---if you can vote with conviction on this, great, but if you can't, I ask you not to vote at all.

G. BONNEN: You know, I really appreciate Representative Faircloth's comments, and I would also add to that---if you look at what's happened to the Gulf Coast Water Authority and you look at what's happened on the board and think about times when we have been asked to make changes to board structures or organizations in the past, there's been, typically, a concern of impropriety or abuse or conflict. We don't have any of that. None of that has occurred. There has been no impropriety, no fraud, no abuse. There hasn't even been division among the members of the board. This is a brute force takeover of the board by two neighboring counties with a minority stake in the Gulf Coast Water Authority. As Representative Faircloth said, I would appreciate that you vote against this piece of legislation. And if you can't vote against it, if you don't represent Fort Bend or Brazoria or Galveston Counties, then I think it would be appropriate to vote present, not voting.

D. BONNEN: I apologize to keep dragging this out, but Representative Faircloth said let's act like adults and do this like adults would do. Adults communicate. Adults come to the table. Adults negotiate. On March 18, the Fort Bend County judge and the Brazoria County judge drove to Galveston County and met with that judge, and they never got a response from him from that date forward. He didn't return phone calls; he didn't return e-mails. We had it right yesterday. I ask you to get it right again today.

FAIRCLOTH: Unless I am mistaken, the board makes the board's decisions. So did the other members that you're referring to from the county judges---did they meet with the full board?

D. BONNEN: Mr. Faircloth, this is a governance question. The governance is controlled by the commissioners courts. The appointments are made largely by the commissioners court in Galveston County and some of the cities. The one appointment Brazoria County has is made by them. But Mr. Faircloth, with all due respect, you can't say let's handle this like adults, and let's do this the right way, but then you want to defend your county judge refusing to even respond to our two county judges who drove down to Galveston, had a meeting with him---he didn't return their phone calls; he didn't return their e-mails. And then you want to stand here and put these members through this discussion saying there's a better way to do it. There is. It's by having our county judges show leadership and work together. Fort Bend County judge, Dr. Zerwas' judge did; my county judge, Ed Thompson's county judge did. But unfortunately, the Galveston County judge where this could have been brought to a reasoned resolution---which, by the way, what those county judges asked for, Mr. Faircloth, was a three--three--three board membership. This bill does four for Galveston---remember this members, it's fair---four for Galveston, three for Brazoria, and two for Fort Bend. It's a fair, reasoned approach to have a regional water authority to govern water for our communities for the next thousand years.

FAIRCLOTH: So it's okay if I work three days a week and you work half a day?

D. BONNEN: Mr. Faircloth, you are playing with the numbers. Fifty-two percent of the water customer is bought off by Galveston, 27 percent is Brazoria, and the rest is Fort Bend, Mr. Faircloth.

FAIRCLOTH: Well, not the revenue. Not the revenue generated.

D. BONNEN: That's right, because the revenue is the number you want to play on. And I told you, if y'all want to, I'll bring my amendment that makes this the Galveston Water Authority. You can't own any assets or have a single contract outside of Galveston County. If you want to control it, you can have exactly what you want, Mr. Faircloth.

FAIRCLOTH: That's not true. That's not true.

D. BONNEN: No, it is true. I have an amendment to do that.

FAIRCLOTH: No, you can have the amendment to do it, but you can't do that.

D. BONNEN: Why can't I?

FAIRCLOTH: That's more of a taking than what we're talking about here.

D. BONNEN: Why could I not do that, Mr. Faircloth? Why would I not be able to do that, Mr. Faircloth? If Galveston County wants ultimate control and authority and say it's all about what you get and what you've got---why could I not do that?

FAIRCLOTH: Well, here's what I would say. We're being adult about this. The issue is currently here. It's not rested between the counties.

D. BONNEN: That's exactly right.

FAIRCLOTH: It's here.

D. BONNEN: That's right.

FAIRCLOTH: And so that's what we're trying to do. That's what we're trying to understand here.

D. BONNEN: I agree with you completely, and that's what we're getting done.

FAIRCLOTH: That's what we're getting done?

D. BONNEN: That's right.

FAIRCLOTH: Well, somehow it just seems like---it's almost like going in and taking over the board of a company. It just seems odd when you have a minority share.

D. BONNEN: How are we taking it over, Mr. Faircloth? You will still have four seats. And I totally understand it's difficult going from complete dominance and control to four and having to have a workable, agreeable relationship with everybody involved. That's an awkward thing for y'all to have to accept, but it's the right thing for long-term water planning.

FAIRCLOTH: When my water rights go back to 1926, it's a little difficult to ignore that. This place came into being, as I said yesterday, as the Galveston County Water Authority.

D. BONNEN: That's correct, and I told you, Mr. Faircloth, I'm glad to return it to the Galveston County Water Authority, but y'all don't want that either.

FAIRCLOTH: We extended services to you, and now we're being asked to take a junior position on the board.

D. BONNEN: It's not a junior position, Mr. Faircloth. How can four seats, the most votes of any county, be junior?

FAIRCLOTH: Well, we're going from seven to four. Four--three--two.

D. BONNEN: Exactly, and that's what I understand y'all are having a hard time with.

FAIRCLOTH: So what happened yesterday, when two counties ganged up on one, which had not happened in the past---on the board it could happen again? That's five-four.

D. BONNEN: Actually, Mr. Faircloth, that's not true. Two counties ganged up on one? Two county judges went and met with a third county judge, and he didn't have the decency to return their phone calls or e-mails or ever communicate with them again about it. Because guess what, if it stays seven to two, you get exactly what you want. And you can call it ganging up; you can call it what you want. But I think the members are now seeing the fairness and the decency that Fort Bend and Brazoria Counties are begging for to put the governance structure of this regional water authority to bed for the next thousand years and have a good structure---that we can all work together respectfully and cooperatively and do the right things for Fort Bend, Brazoria, and Galveston County when it comes to water. That's what we're asking to do.

FAIRCLOTH: Well, it is a sad day to me when we have to come to the legislature to make this decision.

D. BONNEN: I couldn't agree with you more, and if your county judge would return a phone call and an e-mail and show respect to his counterparts in the neighboring counties, maybe we wouldn't have to be here having this argument. I move passage.

FAIRCLOTH: Well, my county judge doesn't run the Gulf Coast Water Authority, and those are the facts.

HB 1596, A bill to be entitled An Act relating to the Hidalgo County Healthcare District; decreasing the possible maximum rate of a tax.

Amendment No. 1

Representatives Guerra, Martinez, Longoria, and Muñoz offered the following amendment to HB 1596:

Amend HB 1596 (house committee printing) as follows:
(1)  On page 2, strike lines 5 and 6 and substitute the following:
providing for the imposition of an ad valorem tax [at a rate not to exceed 75 cents on each $100 valuation] on all taxable property
(2)  Strike page 2, line 21, through page 4, line 14, and substitute the following:
SECTION 5.  Section 1122.051, Special District Local Laws Code, is amended to read as follows:
Sec. 1122.051.  DIRECTORS; TERM. (a)  If the creation of the district is approved at the election held under Section 1122.021, the district shall be governed by a [nine-member] board of 10 directors, appointed as follows:
(1)  the county judge of Hidalgo County shall appoint one director;
(2)  each county commissioner serving on the Hidalgo County Commissioners Court shall appoint one director [four directors];
(3) [(2)]  the governing body of the most populous municipality [with the largest population] in Hidalgo County shall appoint two directors; and
(4) [(3)]  the governing bodies of the second, third, and fourth most populous municipalities [body of the municipality with the second largest population] in Hidalgo County shall each appoint one director[;
[(4)     the governing body of a municipality with the third largest population in Hidalgo County shall appoint one director; and
[(5)     the governing body of a municipality with the fourth largest population in Hidalgo County shall appoint one director].
(b)  Directors serve staggered three-year [four-year] terms, with three or four [as near as possible to one-fourth of the] directors' terms expiring each year.  The [terms of the] initial directors appointed under this section shall draw lots as follows to determine [are as follows]:
(1)  for the directors appointed by the governing bodies of the municipalities in Hidalgo County described by Subsection (a), [shall draw lots to determine] which two directors serve a one-year term, which two directors serve [director serves] a two-year term, and which director serves a three-year term[, and which director serves a four-year term]; and
(2)  for the directors appointed by the Hidalgo County Commissioners Court, including the director appointed by the county judge of Hidalgo County, [shall draw lots to determine] which two directors serve [director serves] a one-year term, which director serves a two-year term, and which two directors serve [director serves] a three-year term[, and which director serves a four-year term].
(c)  On expiration of the initial directors' terms, successor directors shall be appointed for a three-year term by the person or governing body that appointed the initial director.
(d)  A director may not serve more than three [two] consecutive three-year [four-year] terms.
(3)  On page 5, lines 5 and 6, strike "Section 1122.056, Special District Local Laws Code, is" and substitute "Sections 1122.056 and 1122.057, Special District Local Laws Code, are".
(4)  On page 5, between lines 11 and 12, insert the following:
Sec. 1122.057.  VOTING REQUIREMENT.  A concurrence of a majority of the directors voting is necessary in matters relating to district business. In the event of a tie vote among the directors, the county judge of Hidalgo County may cast the deciding vote.

Sec. 1122.2525.  REDUCTION IN AD VALOREM TAX RATE BY COUNTY. The Hidalgo County Commissioners Court, in determining the county ad valorem tax rate for the first year in which the district imposes ad valorem taxes on property in the district, shall:
(1)  take into account the decrease in the amount the county will spend for health care purposes in that year because the district is providing health care services previously provided or paid for by the county; and
(2)  reduce the county's ad valorem tax rate in accordance with the decreased amount of required spending described by Subdivision (1).
(3)  Add the following appropriately numbered SECTION to the bill and renumber subsequent SECTIONS of the bill accordingly:
SECTION ____.  The provisions of this Act or the applications of those provisions are severable as provided by Section 311.032(c), Government Code.

The total amount of repayment assistance distributed by the board under this subchapter may not exceed the total amount available for the program under Section 61.9732 [of gifts, grants, and donations accepted by the board for repayment assistance and tuition set aside under Section 61.9731].
Sec. 61.9732.  LIMITATIONS ON FUNDING. The loan repayment program under this subchapter may be funded only from:
(1)  gifts, grants, and donations accepted by the board; [and]
(2)  legislative appropriations for the program; and
(3)  money budgeted for the program by the office of the attorney general from appropriations made to that office [tuition set aside under Section   61.9731].

(B)  the number of any driver's license, commercial driver's license, or personal identification certificate issued to any person listed in an accident report;
(C)  the date of birth, other than the year, of any person listed in an accident report;
(D)  the address, other than zip code, and telephone number of any person listed in an accident report;
(E)  the license plate number of any vehicle listed in an accident report;
(F)  [the date of any accident, other than the year;
[(G)]  the name of any insurance company listed as a provider of financial responsibility for a vehicle listed in an accident report;
(G) [(H)]  the number of any insurance policy issued by an insurance company listed as a provider of financial responsibility;
(H) [(I)]  the date the peace officer who investigated the accident was notified of the accident;
(I) [(J)]  the date the investigating peace officer arrived at the accident site;
(J)  [(K)     the date the investigating officer's report was prepared;
[(L)]  the badge number or identification number of the investigating officer;
(K) [(M)]  the date on which any person who died as a result of the accident died;
(L) [(N)]  the date of any commercial motor vehicle report; and
(M) [(O)]  the place where any person injured or killed in an accident was taken and the person or entity that provided the transportation.

SECTION 2.____. Section 162.404, Tax Code, is amended to read as follows:
Sec. 162.404.  CRIMINAL OFFENSES: SPECIAL PROVISIONS AND EXCEPTIONS. (a) A person does not commit an offense under Section 162.403 unless the person intentionally or knowingly engaged in conduct as the definition of the offense requires, except that no culpable mental state is required for an offense under Section 162.403(5) [162.403(6)].
(b)  Each day that a refusal prohibited under Section 162.403(8), (9), or (10) [162.403(13), (14), or (15)] continues is a separate offense.
(c)  The prohibition under Section 162.403(27) [162.403(32)] does not apply to the tax-free sale or distribution of diesel fuel authorized by Section 162.204(1), (2), or (3).
(d)  The prohibition under Section 162.403(28) [162.403(33)] does not apply to the tax-free sale or distribution of gasoline under Section 162.104(1), (2), or (3).
SECTION 2.____. Section 162.405, Tax Code, is amended to read as follows:
Sec. 162.405.  CRIMINAL PENALTIES. (a) An offense under Section 162.403(1), (2), (3), (4), (5), [(6),] or (7) [(8)] is a Class C misdemeanor.
(b)  An offense under Section 162.403(8), (9) [162.403(9)], (10), (11), (12), (13), (35), or (36) [(14), (15), (16), (17), (18), (40), or (41)] is a Class B misdemeanor.
(c)  An offense under Section 162.403(14), (15), or (16) [162.403(19), (20), or (21)] is a Class A misdemeanor.
(d)  An offense under Section 162.403(6), (17), (18), (19), (20), (21) [162.403(7)], (22), (23), or (24) [, (25), (26), (27), (28), or (29)] is a felony of the third degree.
(e)  An offense under Section 162.403(25), (26), (27), (28), (29), (30) [162.403(30)], (31), (32), (33), or (34)[, (35), (36), (37), (38), or (39)] is a felony of the second degree.
(f)  Violations of three or more separate offenses under the following sections committed pursuant to one scheme or continuous course of conduct may be considered as one offense and punished as a felony of the second degree:
(1)  Section 162.403(6) [162.403(7)];
(2)  Sections 162.403(8) [162.403(13)] through (11) [(16)]; or
(3)  Sections 162.403(17) [162.403(22)] through (24) [(29)].
SECTION 2.____.  Section 548.051(a), Transportation Code, is amended to read as follows:
(a)  A motor vehicle, trailer, semitrailer, pole trailer, or mobile home, registered in this state, must have the following items inspected at an inspection station or by an inspector:
(1)  tires;
(2)  wheel assembly;
(3)  safety guards or flaps, if required by Section 547.606;
(4)  brake system, including power brake unit;
(5)  steering system, including power steering;
(6)  lighting equipment;
(7)  horns and warning devices;
(8)  mirrors;
(9)  windshield wipers;
(10)  sunscreening devices, unless the vehicle is exempt from sunscreen device restrictions under Section 547.613;
(11)  front seat belts in vehicles on which seat belt anchorages were part of the manufacturer's original equipment;
(12)  [tax decal, if required by Section 548.104(d)(1);
[(13)]  exhaust system;
(13) [(14)]  exhaust emission system;
(14) [(15)]  fuel tank cap, using pressurized testing equipment approved by department rule; and
(15) [(16)]  emissions control equipment as designated by department rule.

SECTION ____.  Section 43.02, Penal Code, is amended by amending Subsections (a), (b), (c), and (d) and adding Subsections (b-1) and (c-1) to read as follows:
(a)  A person commits an offense if, in return for receipt of a fee, the person knowingly:
(1)  offers to engage, agrees to engage, or engages in sexual conduct [for a fee]; or
(2)  solicits another in a public place to engage with the actor [person] in sexual conduct for hire.
(b)  A person commits an offense if, based on the payment of a fee by the actor or another person on behalf of the actor, the person knowingly:
(1)  offers to engage, agrees to engage, or engages in sexual conduct; or
(2)  solicits another in a public place to engage with the actor in sexual conduct for hire.
(b-1)  An offense is established under Subsection (a) regardless of [(a)(1)] whether the actor is offered or actually receives the [is to receive or pay a] fee. An offense is established under Subsection (b) regardless of [(a)(2)] whether the actor or another person on behalf of the actor offers or actually pays the fee [solicits a person to hire the actor or offers to hire the person solicited].
(c)  An offense under Subsection (a) [this section] is a Class B misdemeanor, except that the offense is[:
[(1)]  a Class A misdemeanor [if the actor has previously been convicted one or two times of an offense under this section;
[(2)     a state jail felony] if the actor has previously been convicted three or more times of an offense under Subsection (a).
(c-1)  An offense under Subsection (b) is a Class B misdemeanor, except that the offense is:
(1)  a Class A misdemeanor if the actor has previously been convicted one or two times of an offense under Subsection (b);
(2)  a state jail felony if the actor has previously been convicted three or more times of an offense under Subsection (b) [this section]; or
(3)  a felony of the second degree if the person solicited is younger than 18 years of age, regardless of whether the actor knows the age of the person solicited at the time the actor commits the offense.
(d)  It is a defense to prosecution for an offense under Subsection (a) [under this section] that the actor engaged in the conduct that constitutes the offense because the actor was the victim of conduct that constitutes an offense under Section 20A.02 or 43.05.
(3)  Add the following appropriately numbered SECTIONS to the bill and renumber existing SECTIONS of the bill accordingly:
SECTION ____.  Section 51.03(b), Family Code, is amended to read as follows:
(b)  Conduct indicating a need for supervision is:
(1)  subject to Subsection (f), conduct, other than a traffic offense, that violates:
(A)  the penal laws of this state of the grade of misdemeanor that are punishable by fine only; or
(B)  the penal ordinances of any political subdivision of this state;
(2)  the absence of a child on 10 or more days or parts of days within a six-month period in the same school year or on three or more days or parts of days within a four-week period from school;
(3)  the voluntary absence of a child from the child's home without the consent of the child's parent or guardian for a substantial length of time or without intent to return;
(4)  conduct prohibited by city ordinance or by state law involving the inhalation of the fumes or vapors of paint and other protective coatings or glue and other adhesives and the volatile chemicals itemized in Section 485.001, Health and Safety Code;
(5)  an act that violates a school district's previously communicated written standards of student conduct for which the child has been expelled under Section 37.007(c), Education Code;
(6)  conduct that violates a reasonable and lawful order of a court entered under Section 264.305;
(7)  notwithstanding Subsection (a)(1), conduct described by Section 43.02(a) or (b) [43.02(a)(1) or (2)], Penal Code; or
(8)  notwithstanding Subsection (a)(1), conduct that violates Section 43.261, Penal Code.
SECTION ____.  Section 261.001(1), Family Code, is amended to read as follows:
(1)  "Abuse" includes the following acts or omissions by a person:
(A)  mental or emotional injury to a child that results in an observable and material impairment in the child's growth, development, or psychological functioning;
(B)  causing or permitting the child to be in a situation in which the child sustains a mental or emotional injury that results in an observable and material impairment in the child's growth, development, or psychological functioning;
(C)  physical injury that results in substantial harm to the child, or the genuine threat of substantial harm from physical injury to the child, including an injury that is at variance with the history or explanation given and excluding an accident or reasonable discipline by a parent, guardian, or managing or possessory conservator that does not expose the child to a substantial risk of harm;
(D)  failure to make a reasonable effort to prevent an action by another person that results in physical injury that results in substantial harm to the child;
(E)  sexual conduct harmful to a child's mental, emotional, or physical welfare, including conduct that constitutes the offense of continuous sexual abuse of young child or children under Section 21.02, Penal Code, indecency with a child under Section 21.11, Penal Code, sexual assault under Section 22.011, Penal Code, or aggravated sexual assault under Section 22.021, Penal Code;
(F)  failure to make a reasonable effort to prevent sexual conduct harmful to a child;

(H)  causing, permitting, encouraging, engaging in, or allowing the photographing, filming, or depicting of the child if the person knew or should have known that the resulting photograph, film, or depiction of the child is obscene as defined by Section 43.21, Penal Code, or pornographic;
(I)  the current use by a person of a controlled substance as defined by Chapter 481, Health and Safety Code, in a manner or to the extent that the use results in physical, mental, or emotional injury to a child;
(J)  causing, expressly permitting, or encouraging a child to use a controlled substance as defined by Chapter 481, Health and Safety Code;
(K)  causing, permitting, encouraging, engaging in, or allowing a sexual performance by a child as defined by Section 43.25, Penal Code; or
(L)  knowingly causing, permitting, encouraging, engaging in, or allowing a child to be trafficked in a manner punishable as an offense under Section 20A.02(a)(5), (6), (7), or (8), Penal Code, or the failure to make a reasonable effort to prevent a child from being trafficked in a manner punishable as an offense under any of those sections.

Representative Schaefer raised a point of order against further consideration of CSHB 335 under Rule 4, Section 32(c) of the House Rules on the grounds that the bill analysis is misleading. The point of order is respectfully overruled.
Rule 4, Section 32(c) of the House Rules states that "each committee report on a bill. . .must include in summary or section-by-section form a detailed analysis of the subject matter of the bill." Rule 4, Section 32(c) of the House Rules. Representative Schaefer asserts that the bill analysis for CSHB 335 explains the definition of three of the four terms defined in the bill but fails to define the term "household." Representative Schaefer, therefore, argues, citing a point of order for which no explanation is provided in the house journal, that omitting an explanation of this definition from the bill analysis, while including other definitions, renders the bill analysis misleading in violation of Rule 4, Section 32(c). See 80 H.J. Reg. 5084 (2007) (sustaining without comment a point of order by Dutton on CSSB 785).
The mere fact that a bill defines a term, but the bill analysis "does not state that the bill is defining this key term. . .is not a fatal flaw." 83 H.J. Reg. 3005-3006 (2013) (Martinez Fischer point of order on CSHB 3316); see 83 H.J. Reg. 2815-2816 (2013) (Schaefer point of order on HB 75); 83 H.J. 1st C.S. 1082-1083 (2013) (C. Turner point of order on CSHB 16). Having reviewed the bill and the entire bill analysis, including the side-by-side comparison, the chair finds that CSHB 335's bill analysis complies with the requirements of Rule 4, Section 32(c) of the House Rules.

Representative Rinaldi raised a point of order against further consideration of HB 170 on the grounds that the chair failed to lay the bill on the table subject to call after its senate companion was laid out and subsequently recommitted to committee, thereby contravening house practice and possibly violating Rule 6 of the House Rules. See Rule 6, Sections 1, 16, and 17 of the House Rules (explaining daily order of business and prohibiting deviations from posted calendars); see also Rule 6, Section 10 of the House Rules (obligating the speaker to give the place on the calendar of the house bill to any eligible senate bill and to lay before the house the senate bill to be considered in lieu of the house bill). The point of order is sustained.
When the house reached HB 170 on the calendar, HB 170's senate companion, SB 97, was eligible to be laid out in its place. The chair laid out SB 97 in accordance with Rule 6, Section 10 of the House Rules, and SB 97 was ultimately recommitted to committee pursuant to a motion made by the bill's sponsor.
